Short answer: India mein reservation ek single rule nahi hai jise ek minister, viral campaign ya ordinary notification poore desh ke liye instantly switch off kar de. Constitutional provisions, central/state laws, service rules, institution-specific notifications aur court judgments milkar framework banate hain.
Constitution kya permit karta hai?
Article 15 equality aur specified grounds par discrimination se related hai, saath hi socially and educationally backward classes, Scheduled Castes, Scheduled Tribes aur educational admissions ke liye special provisions ka constitutional space deta hai. Article 16 public employment mein equality of opportunity aur backward classes ke representation-related provisions cover karta hai.
EWS reservation ke liye Constitution mein Articles 15(6) aur 16(6) add kiye gaye. Isliye “reservation” ek uniform bucket nahi—different categories ka legal source aur field of application differ kar sakta hai.
Parliament kya change kar sakti hai?
Parliament ordinary legislation aur, where necessary, Article 368 ke constitutional-amendment process ke through framework change kar sakti hai. Lekin constitutional amendment bhi judicial review se completely immune nahi hota. Supreme Court basic-structure doctrine ke under constitutional amendments examine kar sakta hai.
Isliye “simple majority se kal reservation khatam” type social posts incomplete ho sakte hain. Exact proposal dekhe bina required voting threshold ya legal validity state nahi ki ja sakti.
State governments ka role
State public employment, educational institutions aur state lists/rosters ke context mein apne laws, rules aur notifications operate karte hain—subject to Constitution and judicial review. Isi wajah se category percentages aur implementation details states ke beech differ kar sakte hain.
State cabinet announcement aur enforceable law/rule same cheez nahi. Gazette notification, statutory text, implementation date aur pending litigation separately check karna chahiye.
Supreme Court reservation banata hai ya review karta hai?
Courts legislation create karne wali legislature nahi hain. Courts challenged laws, amendments, classifications, data, procedures aur constitutional compliance review karte hain. Court kisi provision ko uphold, interpret, limit ya invalidate kar sakta hai depending on case and record.
Headline ko universal rule samajhne se pehle judgment ka operative part, bench, date aur case context padhein.
50% ceiling kya absolute rule hai?
1992 ke Indra Sawhney judgment ko reservation ceiling discussion mein central precedent maana jata hai, commonly described as 50% ceiling with exceptional-circumstance reasoning. Lekin current legal landscape ko sirf ek slogan mein compress nahi kiya ja sakta. EWS constitutional amendment ko Supreme Court ne 2022 ke Janhit Abhiyan decision mein majority se uphold kiya. State-specific laws aur later judgments bhi matter karte hain.

Vertical aur horizontal reservation
- Vertical reservation: SC, ST, OBC, EWS jaise category buckets.
- Horizontal reservation: PwD, women, ex-servicemen jaise provisions jo vertical categories ke across apply kar sakte hain.
- Horizontal seats ko vertical total se dobara subtract karna double counting create kar sakta hai; exact roster rules decisive hain.
Open category ka matlab
Open/unreserved seats “sirf general caste ke liye reserved” seats nahi hote. Applicable merit and eligibility rules ke under reserved-category candidates bhi open seats par qualify kar sakte hain without consuming their category quota, subject to governing rules and selection method.
